Parking Rules (Informational Copy)

Section 8
Motor Vehicles and Parking Rules

Common Area Parking are those spaces marked in some firelanes/alleys that provide parking for guest and residents. Some alleys are not wide and firelanes only. NO PARKING IN FIRELANES. California Vehicle Code Section 22500.1

  1. The use of Common Area parking facilities shall be in accordance with the rules and regulations adopted by the Board of Directors. CC&R’s Article III.10

  2. The common area parking spaces are for all residents and their guests for no more than 72 hours. Vehicles parked in excess of 72 hours are subject to removal and impoundment at the owner’s expense. Section 22558.2 of California Vehicle Code

  3. The common area parking shall NOT be used for storage of vehicles. It is the intent of this paragraph to limit the movement of any vehicle to circumvent the 72 hour rule. Moving vehicle to another space shall be considered an attempt to circumvent the 72 hour rule.

  4. No resident shall park, store or keep any large commercial type vehicle (dump truck, cement mixer, truck, oil or gas truck, etc.), any recreational vehicle (camper unit, motor home, trailer, boat trailer, mobile home or other similar vehicle), boats, or any vehicle other than private passenger vehicle in the common area parking. The above excludes camper trucks up to and including three-quarter (3/4) ton when used for everyday type transportation. They will be subject to 72 hour rule.

  5. The marked Common Area parking and firelanes/alleys shall not be used for vehicle repair. CC&R’s Article III.7

  6. Disregarding the Common Area parking rules is a violation of Section 22658.2 of the California Vehicle Code and is enforceable by tow away at the expense of the owner of that vehicle. California Vehicle Code Section 22658.2
    (a) A violation notice will be posted on all vehicles illegally parked more than 72 hours. This notice fulfills requirements of Vehicle Code Section 22853 (Notice of removal).

  7. Unattended parking is prohibited in the firelanes. Firelanes are emergency vehicles and access to garages. California Vehicle Code Section 22500.1

  8. Parking behind “CLOSED” garage doors in alley way is not allowed at anytime.

  9. Parking behind “open” garage doors during daylight hours is permissible to facilitate; loading and unloading, contract worker vehicles, routine garage cleaning and performance of other services at the residence.

  10. The speed limit in the firelanes is that considered to be safe but no more than 5 miles per hour. Watch out for children, pets and your neighbors.

FAILURE TO COMPLY WITH THE RULES IN THIS SECTION WILL SUBJECT THE HOMEOWNER TO A HEARING BY THE BOARD OF DIRECTORS AND AN ASSESSMENT OF UP TO $100.00 FOR EACH OFFENSE AND IN ADDITION THE RIGHT OF THE ASSOCIATION TO TOW-AWAY WITHOUT NOTICE ANY PARKING VIOLATOR AT THE EXPENSE OF THE OWNER OF THE VEHICLE.
